Payment

• Full payment is required at the time of booking to reserve your consultation date and time.

• Consultations are scheduled on a first-come, first-served basis and are not confirmed until payment has been received.

• Transportation fees, if applicable, will be an additional invoice sent to the customer after the consultation payment is verified.

Rescheduling

Need to change your appointment? No problem.

• Rescheduling requests made 48 hours or more before your appointment may be made at no additional charge.

• One complimentary reschedule is included. Additional reschedules may be subject to a scheduling fee.

Cancellation Policy

• Cancellations made 48 hours or more before the scheduled consultation will receive a full refund.

• Cancellations made 24–48 hours before the appointment will receive a 50% refund.

• Cancellations made less than 24 hours before the appointment, or failure to be present at the scheduled time ("no-show"), are non-refundable.

Weather & Emergencies

If severe weather or an emergency prevents either party from safely attending the consultation, the appointment will be rescheduled at no additional charge.

Arrival & Consultation Time

Please ensure access to the property at the scheduled appointment time. Consultation time begins at the scheduled start time. If access is delayed, the consultation will still conclude at the scheduled end time unless additional time is available.

Thank you for respecting these policies. They allow Backyard HOAmstead to provide reliable scheduling and dedicated service for every client.

Because consultation time is reserved exclusively for each client, consulting fees are generally non-refundable once services have been provided.

Refunds may be considered only under the following circumstances:

• Duplicate payments.

• Accidental overpayments.

• Cancellation by Backyard HOAmstead when a rescheduled appointment cannot be accommodated.

• Other situations at the sole discretion of Backyard HOAmstead.

No refunds will be issued because a client chooses not to implement recommendations, disagrees with recommendations, experiences unsuccessful gardening or livestock outcomes, is denied HOA approval, or encounters weather, pest, disease, wildlife, contractor, or permitting issues.

Digital reports, written recommendations, property layouts, educational materials, and custom planning documents are non-refundable once delivered.

If a consultation must be canceled due to severe weather, emergency, illness, or other circumstances beyond reasonable control, Backyard HOAmstead may offer rescheduling or a refund at its discretion.

By scheduling or participating in a Backyard HOAmstead consultation, I acknowledge and understand that gardening, landscaping, irrigation, and backyard livestock activities involve inherent risks that cannot be completely eliminated.

These risks may include, but are not limited to:

• Uneven ground, slopes, holes, rocks, roots, mud, and other tripping hazards.

• Exposure to heat, cold, rain, lightning, insects, spiders, snakes, wildlife, and plants that may cause allergic reactions or injury.

• Contact with soil, compost, mulch, fertilizers, tools, irrigation equipment, fencing, raised beds, and other outdoor structures.

• Exposure to domestic animals, poultry, rabbits, quail, ducks, or other livestock, including scratches, bites, pecking, kicking, or allergic reactions.

• Exposure to dust, pollen, mold, manure, feathers, animal dander, and other agricultural materials.

• Risks associated with implementing recommendations after the consultation, including construction, excavation, irrigation installation, livestock housing, and landscape modifications.

I understand that Backyard HOAmstead provides educational consulting services and does not supervise construction, installations, or ongoing property maintenance.

I voluntarily assume all risks associated with participation in the consultation and with implementing any recommendations provided.

In consideration for receiving consulting services from Backyard HOAmstead, I voluntarily agree to the following:

I release, waive, and discharge Backyard HOAmstead, its owner, employees, contractors, volunteers, representatives, and affiliates from any and all claims, demands, causes of action, damages, losses, costs, or expenses arising out of or relating to my participation in the consultation or my implementation of any recommendations provided.

This release includes, but is not limited to, claims involving:

• Personal injury.

• Property damage.

• Plant loss or crop failure.

• Livestock injury, illness, death, escape, or predation.

• HOA violations or enforcement actions.

• Permit denials.

• Code violations.

• Irrigation failures.

• Drainage issues.

• Utility damage.

• Financial loss.

• Lost profits.

• Neighbor disputes.

• Contractor errors.

• Equipment failures.

• Weather-related damage.

• Pest or disease outbreaks.

I understand that Backyard HOAmstead does not guarantee any specific results, including plant growth, harvest yields, animal productivity, property value increases, regulatory approval, or cost savings.

I agree that I am solely responsible for verifying all applicable HOA rules, local ordinances, zoning requirements, permits, utility locations, and state or federal regulations before implementing any recommendation.

To the fullest extent permitted by Texas law, any liability of Backyard HOAmstead shall be limited to the amount paid for the consultation giving rise to the claim.

If any provision of this Waiver and Release is found to be unenforceable, the remaining provisions shall remain in full force and effect.

By purchasing, scheduling, or participating in consulting services, I acknowledge that I have carefully read and fully understand this Waiver and Release of Liability and voluntarily agree to its terms.
